TERMS OF USE

These Terms of Use govern access to and use of the Airsoft and Paintball Association website, standards, programs, resources, activities, certifications, event support, and related services.

By accessing this website, registering for Association programs, participating in an activity conducted under Association standards, or using Association resources, you acknowledge and agree to these Terms.

1. ROLE OF THE ASSOCIATION

The Airsoft and Paintball Association exists to support the professional development of Airsoft and Paintball through standards, safety, fair play, education, training, field development, event guidance, international cooperation, and community development.

Unless expressly stated otherwise for a particular activity, the Association acts as a:

• Standards-setting organization
• Facilitator
• Industry and community coordinator
• Educational and training body
• Event-support organization
• Safety and compliance guidance body

The Association is not automatically the owner, promoter, commercial operator, employer, contractor, or financial manager of events conducted by independent organizers.

2. INDEPENDENT EVENT ORGANIZERS

Airsoft and Paintball tournaments, MilSim events, competitions, training programs, recreational games, exhibitions, and other activities may be organized by independent:

• Individuals
• Companies
• Clubs
• Teams
• Field operators
• Promoters
• Licensees
• Franchise partners
• Local organizing committees
• Other third-party organizations

Unless an event is specifically identified in writing as being directly organized and operated by the Association, the event organizer is an independent entity and is solely responsible for the management and operation of its event.

Use of Association standards, branding, approval, certification, promotion, consultation, or support does not by itself create an employment relationship, partnership, joint venture, agency relationship, or transfer of operational responsibility to the Association.

3. EVENT-ORGANIZER RESPONSIBILITY

Each independent organizer is responsible for all aspects of its own event, including:

• Event planning and management
• Participant registration
• Ticket sales and refunds
• Financial obligations
• Venue and field rental
• Employees, contractors, volunteers, referees, and marshals
• Local permits and approvals
• Insurance
• Taxes and business obligations
• Security and crowd management
• Equipment and infrastructure
• Medical and emergency planning
• First-aid personnel
• Transportation arrangements
• Food and beverage operations
• Vendors and suppliers
• Participant waivers
• Safety implementation
• Compliance with local law
• Handling complaints, incidents, injuries, and disputes

The organizer remains responsible for its employees, contractors, agents, suppliers, vendors, and other persons engaged in the operation of its event.

4. ASSOCIATION STANDARDS AND OVERSIGHT

The Association may establish or publish standards relating to:

• Playing rules
• FPS and Joule limits
• Engagement distances
• Protective equipment
• Eye and face protection
• Player conduct
• Referee and marshal standards
• Field standards
• Safety inspections
• First-aid and emergency readiness
• Event operations
• Fair play
• Professional conduct

The Association may inspect, review, advise, certify, monitor, or evaluate participating fields and events.

However, Association inspection, approval, certification, guidance, or monitoring does not guarantee that an event or field is free from risk, nor does it transfer operational responsibility from the organizer or field operator to the Association.

5. PARTICIPANT ASSUMPTION OF RISK

Airsoft and Paintball are active sports that involve inherent risks.

Such risks may include, without limitation:

• Projectile impact
• Slips, trips, and falls
• Uneven terrain
• Physical contact
• Weather conditions
• Equipment malfunction
• Noise
• Heat exposure
• Fatigue
• Obstacles
• Structures
• Vehicles
• Natural terrain
• Actions of other participants

By voluntarily participating, each participant acknowledges that these activities involve risks that cannot be completely eliminated even when reasonable safety precautions are followed.

Participants are responsible for assessing their own ability to participate safely and for complying with all event rules, safety instructions, and protective-equipment requirements.

6. PARTICIPANT WAIVER AND EVENT-SPECIFIC RELEASE

Independent event organizers may require participants to sign a separate waiver, release, assumption-of-risk form, medical acknowledgment, parental consent form, or other participation agreement before entering an event.

Such documents are agreements between the participant and the relevant organizer or field operator unless the Association is expressly named as a party.

Participants should carefully review all event-specific terms before signing or participating.

Nothing in these Terms is intended to waive or exclude any legal right or responsibility that cannot lawfully be waived or excluded under applicable law.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the Airsoft and Paintball Association, its directors, officers, committee members, employees, volunteers, representatives, advisers, and authorized personnel will not be responsible for losses or damages arising solely from the operation of an independently managed event.

This may include, where legally permitted:

• Personal injury
• Property loss or damage
• Event cancellation
• Financial losses
• Ticket or refund disputes
• Business disputes
• Vendor disputes
• Transportation problems
• Accommodation issues
• Equipment loss
• Third-party conduct
• Organizer misconduct
• Operational failures
• Contractual disputes between participants and independent organizers

The Association's role in establishing standards, facilitating introductions, promoting an event, providing consultation, inspecting a facility, or granting Association recognition does not make the Association responsible for the independent organizer's business or operational decisions.

Nothing in these Terms excludes liability where exclusion or limitation would be prohibited by applicable law.

8. NO GUARANTEE OF ABSOLUTE SAFETY

The Association seeks to improve safety through standards, education, inspection, training, and professional practices.

However, no inspection, standard, certification, safety program, or operating procedure can eliminate every possible risk associated with Airsoft, Paintball, sporting activities, outdoor environments, or large events.

Participants remain responsible for following safety instructions and exercising reasonable care at all times.

9. THIRD-PARTY PRODUCTS AND SERVICES

The Association may identify, recognize, recommend, sponsor, list, or cooperate with:

• Fields
• Hotels
• Transportation providers
• Retailers
• Manufacturers
• Sponsors
• Equipment providers
• Training providers
• Event organizers
• Tourism companies
• Other businesses

Such relationships do not constitute an unconditional guarantee of the quality, safety, financial condition, performance, or reliability of any third party.

Any contract or transaction between a user and a third party is normally between those parties directly.

10. PERSONAL DATA AND PDPA

The Association respects the privacy of members, players, participants, website visitors, partners, and other individuals whose personal information may be collected or processed.

Where applicable, personal data will be handled in accordance with Thailand's Personal Data Protection Act B.E. 2562 (2019) (PDPA) and other applicable privacy requirements.

Personal information may be processed for purposes including:

• Membership administration
• Event registration
• Player identification
• Team registration
• Safety administration
• Emergency contact
• Certification
• Training
• Competition administration
• Communications
• Payments
• Legal compliance
• Security
• Marketing or promotional activities where permitted
• Photography and event media where appropriately notified or authorized

The Association will seek to process personal data only where there is an appropriate legal basis and for legitimate, specified purposes.

11. EVENT ORGANIZERS AND PERSONAL DATA

Independent organizers may collect personal information separately for their own events.

When doing so, they are responsible for determining and complying with their own obligations under applicable data-protection laws.

This may include responsibility for:

• Providing an appropriate privacy notice
• Identifying the purpose of data collection
• Establishing an appropriate legal basis
• Obtaining consent where legally required
• Protecting participant information
• Controlling access to personal data
• Maintaining appropriate security
• Establishing retention periods
• Responding to data-subject requests
• Managing data breaches
• Controlling transfers to third parties
• Managing international data transfers where applicable

The Association is not automatically responsible for personal data independently collected and controlled by a third-party event organizer.

12. DATA SHARING

Where reasonably necessary and legally permitted, the Association may share relevant information with:

• Event organizers
• Field operators
• Referees and officials
• Medical or emergency personnel
• Technology providers
• Payment providers
• Professional advisers
• Government agencies
• Regulatory authorities
• Other service providers supporting Association activities

Only information reasonably necessary for the relevant purpose should be disclosed.

13. DATA SECURITY

Reasonable administrative, technical, and organizational safeguards should be used to protect personal information from unauthorized access, loss, misuse, alteration, disclosure, or destruction.

Where independent organizers receive Association-related personal information, they are expected to maintain appropriate security and confidentiality measures.

No electronic or physical information system can guarantee absolute security.

14. DATA RETENTION

Personal information should be retained only for as long as reasonably required for the purpose for which it was collected, or as required for legitimate administrative, contractual, safety, accounting, regulatory, or legal purposes.

When information is no longer required, it should be securely deleted, destroyed, or anonymized as appropriate.

15. DATA-SUBJECT RIGHTS

Subject to applicable law, individuals may have rights relating to their personal information, including rights to:

• Access personal information
• Request correction
• Request deletion
• Restrict certain processing
• Object to certain processing
• Withdraw consent where applicable
• Request data portability where applicable
• Raise concerns or complaints about the handling of personal information

The Association will maintain appropriate procedures for handling valid requests.

16. PHOTOGRAPHY, VIDEO AND EVENT MEDIA

Airsoft and Paintball events may involve photography, video recording, livestreaming, interviews, promotional filming, and media coverage.

Organizers should provide appropriate notice regarding event photography and obtain consent where required by applicable law or circumstances.

Images or recordings may be used for legitimate purposes including:

• Event coverage
• Association websites
• Social media
• News
• Advertising
• Event promotion
• Education
• Historical archives

Special care should be taken where children or minors are involved.

17. MINORS

Participation by minors may be subject to additional restrictions, age requirements, parental or guardian consent, safety requirements, and event-specific rules.

Organizers are responsible for implementing appropriate procedures for minors participating in their events.

18. INTELLECTUAL PROPERTY

Unless otherwise stated, Association logos, standards, training materials, event systems, written content, graphics, certification marks, and original materials remain the intellectual property of the Association or their respective rights holders.

No person may use Association branding or represent an event as Association-approved, certified, licensed, or endorsed without appropriate authorization.

19. MISUSE OF ASSOCIATION NAME OR BRAND

The Association reserves the right to withdraw approval, certification, partnership status, or permission to use its name or marks where an organizer, field, team, company, or individual:

• Violates Association standards
• Misrepresents Association involvement
• Creates a material safety risk
• Engages in serious misconduct
• Damages the reputation or integrity of the sport
• Uses Association branding without permission

20. CHANGES TO THESE TERMS

The Association may revise these Terms from time to time to reflect changes in laws, regulations, Association standards, technology, operations, or activities.

The latest version will be published on the official website with the applicable revision date.

21. GOVERNING LAW

These Terms should be interpreted in accordance with applicable law and any mandatory legal requirements governing the relevant activity, transaction, or jurisdiction.

Where an independently organized event is held in another country or jurisdiction, additional local laws, regulations, participant terms, and event conditions may apply.
